1. Who We Are
The company responsible for your data (the “data controller”) is: Mel Inc.. You can contact us as described in Section 12.
2. Where This Privacy Policy Applies
This Privacy Policy applies to the services operated by Mel Inc. (the “Services” or “Mel”), including when you browse content made available without creating an account.
3. Data We Collect
It goes without saying, we can’t help you develop a meaningful connection with AI virtual companions(s) (“AIs”) without you providing some information about yourself, such as basic profile details and preferences for AIs. Using our service also generates information, including details like when you logged in and how you used the service. Additionally we may also collect data from third parties when you upload information from your account on another platform. Check out the table below for more details

Sensitive data
The Services allow you to input information that may be sensitive and subject to special protections under applicable laws. This section explains how we use and protect sensitive information.
- Sensitive information you provide in your profile and content While you make your profile or in your conversations with AIs, you may choose to provide information about your religious views, sexual orientation, political views, health, racial or ethnic origin, philosophical beliefs, or trade union membership. You may also provide live video of your face and audio of your voice when you interact with AIs (see “Face Data” below for how this data is handled). We do not process this content to generate biometric identifiers (such as a faceprint or voiceprint) and we do not use it to uniquely identify you; accordingly, we do not collect or use biometric information. By providing sensitive data, you consent to our use of it for the purposes set out in this Privacy Policy. Note, however, that we will not use your sensitive data for marketing or advertising.
Face Data
Mel does not collect face data. We do not perform facial recognition, and we do not create, collect, or derive facial maps, facial landmarks, facial geometry, faceprints, or any other biometric identifiers from your camera feed, photos, or videos, and we do not use them to identify you. We do not use any imagery of your face for authentication, advertising, or marketing purposes.
During a video chat with an AI, if you choose to enable your camera, camera frames — which may incidentally include your face — are transmitted in real time over encrypted channels operated by LiveKit (our real-time audio/video infrastructure provider) to the AI providers that perform vision analysis (Google and OpenRouter), solely to generate a plain-text description of what is visible so that the AI can respond with conversational context. No facial features are extracted, measured, or used to identify you.
Camera frames are processed ephemerally and are never stored on our servers: each frame is discarded immediately after real-time processing. The AI providers process camera frames only to provide this real-time analysis and retain related data only for the period necessary to provide their services and to detect abuse, as described in Section 9. The derived plain-text description contains no biometric data, is held only temporarily on our servers — hosted on Amazon Web Services in the us-west-2 (Oregon, United States) region — for the duration of the video-chat session, and is automatically deleted when the session ends. It is not stored as part of your conversation history. Nothing from your camera feed, including the text description, is retained by us after the video chat ends.
Photos or videos you separately choose to upload (for example, a profile picture or content you post) may include your face; we treat these as ordinary user content under this Privacy Policy and do not extract biometric identifiers from them.
We ask for your permission before enabling your camera and before sharing your data with the third-party AI providers listed in Section 5. You can stop the collection and sharing of camera data at any time by turning off your camera during the chat or by disabling the app’s camera access in your device settings; because nothing from your camera feed is retained, no residual camera data remains once you do so. You may also exercise your other rights, including withdrawing your consent to our processing of your data, as described in the “Personal information requests” part of Section 7.
5. How We Share Data
In order for us to operate the service, some of your information may be shared with our service providers. Read on for more details.

Each third party with whom we share your data — including the service providers and AI service providers described above — will provide the same or equal level of protection for your data as set out in this Privacy Policy. These providers may use your data only to provide their services to us, and do not use your personal data to train their own AI models.
Once you share a recording or other information publicly or with others (including on the Feed), that content is governed by the receiving platform’s own terms and privacy policy, and we may be unable to control, retrieve, or delete it. You are responsible for the content you choose to record and share.
6. Consent to Transfers
Our services are global and your information may be stored and processed in the United States or other countries outside your own. These countries may have data protection laws that differ from those in your country, and under certain circumstances, data may be accessible to law enforcement and national security authorities. By using the Services or providing us with any information, you consent to the collection, processing, maintenance, and transfer of such information in and to the United States and other applicable countries. Please note that the privacy laws in these countries may not be as comprehensive as, or equivalent to, those in the country where you reside or hold citizenship.
In particular, when you chat with AIs or use media-generation features, your data is processed in the United States by the AI service providers listed in Section 5 (with video-generation requests also processed in Singapore by Kling). These providers may process data in other locations and share it within their corporate groups, as described in their own privacy policies. Our servers are hosted on Amazon Web Services in the United States (us-west-2, Oregon).
7. Your Rights and choices
Opt-out of marketing communications
You may opt out of marketing-related emails and other communications by following the opt-out or unsubscribe instructions in the communications you receive from us or by sending an email to support@bvrly.ai. Please note that you may continue to receive service-related and other non-marketing emails and communications from us.
Opt-out of selling personal information and sharing for targeted advertising
We may use third-party analytics services and online advertising services, allowing them to collect information about your visit to the Services using cookies and other tracking technologies. For more detail, please refer to Cookie Policy. Also you can opt out of these disclosures and limit our use of tracking technologies as described in our Cookie Policy.
Limit our use of sensitive data
If you choose to provide sensitive personal information, we will use that information only to facilitate your conversation with AIs and as described in the “Sensitive information” section above. If you do not want us to process your sensitive information for these purposes, please do not provide it. You may request that we delete information you have provided as set out in the “Personal information requests” section below.
Personal information requests
You have the right to: (a) request access to your data; (b) request rectification of your data; (c) request erasure of your data; (d) withdraw your consent to the processing of your data; (e) request restriction of processing of your data; and (f) object to the processing of your data.
You can exercise any right that you may have under applicable privacy law and inquire or complain about this Privacy Policy by contacting us at support@bvrly.ai. We will respond to such requests in accordance with applicable data protection law. Keep in mind, we may not be able to accommodate all requests, such as if we are unable to authenticate your identity, if the request is unlawful, if it may infringe on the privacy of another member, or if it would prevent us from providing our service. If we cannot accommodate your request, we will promptly inform.
For your protection and the protection of all of our members, we may ask you to provide information to verify your identity or authority to act on behalf of a member before addressing your requests. We would not want someone else to get in control of your data!
In certain countries, you have the right to lodge a complaint with the appropriate data protection authority if you have concerns about how we are processing your personal data.
8. Children’s Privacy
The Service is restricted to individuals who are 18 years of age or older. We do not allow individuals under the age of 18 to use our platform. If we have reason to believe that an account holder is under 18, we will suspend the account and explain how the account holder can verify their age. Age verification may be performed through a third-party verification partner, and we process the information provided to, or generated by, that partner only for the purpose of verification. We delete or de-identify that information once verification is complete, except where we are required to retain it by law. If age is not verified within the period stated in our notice (which will be no less than fourteen (14) days), we will terminate the account and delete the associated personal information, subject to legal retention obligations. If you believe that a minor under the age of 18 has provided personal information to us through the Service, please contact us, and we will endeavor to delete that information from our databases.
9. Data Retention
We keep your information for the time necessary for the purposes for which it is processed. The length of time for which we retain information depends on the purposes for which we collected, how use it used, and your choices. After this period, we may delete or aggregate the information. We may also retain and use this information as required to comply with our legal obligations, resolve disputes, and enforce our agreements. Please note: If you create a User AI(s) that is made available to other users (Public), we may preserve the non-personally identifiable characteristics and persona of that User AIs to keep it active for the community, even if you delete your account or your account is suspended or terminated (including for violations of our Terms of Use). We do this to avoid impacting the experience of other users who have interacted with that User AI.
Third-party AI providers that power our AI features retain data only for the period necessary to provide their services to us and to detect abuse (for example, Google retains abuse-monitoring logs for up to 55 days, and Replicate automatically deletes API request data approximately one hour after processing). These providers do not use your personal data to train their own AI models.
10. Regional Privacy Disclosure
Residents of Nevada
If you are a resident of Nevada, you have the right to opt-out of the sale of certain personal information to unaffiliated parties. You can exercise this right by contacting us via support@bvrly.ai with the subject line “Nevada Do Not Sell Request” and providing us with your name and the email address. We do not currently sell your personal information as sales are defined in Nevada Revised Statutes Chapter 603A.
Residents of California
The California Consumer Privacy Act (“CCPA”) sets forth certain obligations for businesses that “sell” or “share” personal information. Where we refer to “sell” or “share” (or their variants) in quotes, we are referring to those terms as uniquely defined in the CCPA. We do not currently “sell” personal information; however, we may use third-party analytics services and online advertising services that may result in the “sharing” of online identifiers (e.g., cookie data, IP addresses, device identifiers, general location information, and usage information) with advertising vendors to advertise the Services on other websites. If you would like to opt out of our “sharing” of your information for such purposes, you may do so by using the tools described in the “How to Control Cookies” section in the Cookie Policy, which are also available here. We do not knowingly “sell” or “share” the personal information of children under 16.
Do-Not-Track disclosure
We do not respond to browser-initiated Do Not Track signals, as the Internet industry is currently still working on Do Not Track standards, implementations, and solutions.
Residents of the Republic of Korea
Our Services are provided using servers and service providers located outside of Korea. In accordance with the Personal Information Protection Act of Korea, we disclose the following details of the overseas transfer (processing consignment and storage) of personal data. The transfer occurs at the time you use the relevant feature, via encrypted network transmission.

You may refuse the overseas transfer of your personal data by contacting us at support@bvrly.ai. However, because our Services are provided entirely through the above overseas processing, refusal will result in the inability to use the Services. Refusal or withdrawal does not affect the lawfulness of processing before such refusal.

This policy may change over time. We’re always looking for new and innovative ways to help you build meaningful connections and strive to make sure explanations of our data practices remain up-to-date. We will notify you before material changes take effect so that you have time to review the changes.
